Patent Registration in India
Creating something new is stimulating. But what if someone else claims your invention as theirs? That’s really scary. Many inventors in India face this risk because their ideas aren’t legally protected. They don’t know how to secure a patent or think the process is too difficult or expensive. Registering a patent is rather easy when you hire a patent agent in India.
Jitendra Consulting Group India (JCI) is a top patent agent in India that lets you register your patent easily, at a single cost and in a short time.
What Is a Patent?
A patent is a legal right given by the government to an inventor. It gives the person full control over how the invention is used. This means no one else can make, use, or sell the invention without permission. The protection lasts for a limited time, usually 20 years.
But not everything can be patented. For example, books or movies are not covered under patents. They fall under copyright laws. Patents are meant for inventions — like machines, devices, formulas or new ways of doing things, etc.
Types of a Patent
There are 2 main types of patents in India; Conventional Patent and Inventions Patent. Subtypes are; Design patent, Utility patent.
Who Can Apply for a Patent in India?
Anyone who has created something new can apply for a patent. This includes:
- Individual inventors
- Startups
- Small businesses
- Large companies
- Research institutions
The main rule is that the person or group applying must be the actual creator. If more than one person worked on the invention, all their names should be mentioned. Ownership can also be transferred later, but the original inventor(s) must be listed at the time of application.
What Can Be Patented in India?
To get a patent, the invention must meet three conditions:
- New: It should not already exist anywhere in the world.
- Useful: It should solve a problem or add value.
- Original: It should not be a simple improvement of something already known.
Also, it should not break any law or moral standard. Anything illegal or harmful cannot be patented.
What Cannot Be Patented in India?
Indian patent law clearly lists things that cannot be patented. These include:
- Farming and gardening methods
- Treatments for humans or animals (like surgeries or medicines)
- Discoveries related to atomic energy
- Natural laws or scientific theories (like gravity)
- Any invention that promotes illegal use
Understanding what is not allowed can save time before filing an application.
Step-by-Step Process of Patent Registration in India
Check If Your Idea Is Patentable
Before filing, it’s smart to search if something similar already exists. JCI can help you in a deep search. You can also use India’s official public search tool:
https://iprsearch.ipindia.gov.in/publicsearch
Fill out the Application Form
JCI helps you prepare your documents properly. Our experts will help you fill out:
- Form 1 – Application for grant of patent
- Form 2 – Provisional or complete specification
If your invention is still in progress, you can file a provisional application. This gives you 12 months to finish and file the complete one. JCI experts will help you with how to do it.
JCI will help you prepare a patent draft — a document that explains your invention in detail. The patent office uses this to decide if the patent should be granted.
File the Patent Application
Along with the forms, depending on your situation, JCI will help you fill out:
- Form 3 – If a patent application is already filed abroad
- Form 5 – Declaration of inventorship
- Form 28 – For startups and small entities
JCI will submit your application either online or physically.
Publication of Your Patent
After the filing is complete, your application will be published in the Patent Office Journal after 18 months. If you want it published earlier, submit Form 9 for early publication. JCi will help you do it.
Some inventions are restricted by Indian law and won’t be published.
Request for Examination
The process does not end here. There are still more steps, but don’t worry. JCI will help you request that your application be examined using Form 18. The sooner we do this, the quicker your application will be reviewed.
The patent officer checks your invention and compares it with existing knowledge. If there are any issues, they send a report called the First Examination Report (FER).
You need to respond to their objections. JCI will help you deal with the authorities. Once all concerns are cleared, the patent can be granted.
Patent Granted
After everything is in order and objections are settled with the help of JCI, your patent will be officially granted. You now have full control over your invention for 20 years.
